By accessing or using the South Gate Asphalt Paving website located at southgateasphaltpaving.com ("Site"), or by requesting, scheduling, or accepting services from South Gate Asphalt Paving ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. These terms apply to all visitors, customers, and anyone else who accesses the Site or engages with the Company.
South Gate Asphalt Paving is a licensed asphalt paving contractor providing services including, but not limited to, asphalt paving, sealcoating, crack sealing, parking lot striping, driveway paving, pothole repair, asphalt resurfacing, and related pavement services in South Gate, CA and surrounding areas.
Services are provided on a project basis as agreed in a written estimate or contract. This website is for informational purposes and to facilitate contact with potential customers. No contract for services is formed by browsing this website or submitting an inquiry form. A binding agreement is established only when both parties sign a written estimate or contract document.
All estimates provided are based on information gathered during an on-site assessment and are valid for the period specified in the written estimate document. Prices are subject to change if the scope of work changes after the estimate is issued, if material costs change significantly before work begins, or if site conditions differ materially from those observed during the estimate visit.
Estimates are not guarantees of final cost. If additional work or materials are required beyond the original scope, we will notify the customer before proceeding and obtain approval. Verbal estimates are not binding. All pricing agreements must be in writing.
Work dates are scheduled upon execution of a written agreement and, where required, receipt of any deposit. We will make reasonable efforts to complete work on the agreed schedule, but delays may occur due to weather, material availability, equipment issues, or other circumstances outside our control. We will notify customers of any schedule changes as promptly as possible.
Customers who need to cancel or reschedule should notify us at least 48 hours in advance. Cancellations made after materials have been ordered or crews have been dispatched may result in cancellation fees as specified in the written agreement. We reserve the right to cancel or reschedule jobs due to unsafe weather conditions or circumstances that would prevent the work from meeting our quality standards.
Asphalt and sealcoating work requires dry weather and appropriate temperatures to cure correctly. Jobs may be postponed if conditions are unsuitable on the scheduled date.
Payment terms are specified in the written estimate or contract for each project. Unless otherwise agreed in writing, payment is due upon completion of the work. For larger projects, a deposit may be required before work begins, with the balance due upon completion.
Accepted payment methods will be specified in the written agreement. Invoices that are not paid within the agreed timeframe may be subject to late fees as specified in the contract. Accounts that remain unpaid may be referred to a collections agency or pursued through legal action, with all associated costs the responsibility of the customer.

We stand behind our workmanship. Any warranty terms applicable to a specific project will be stated in the written contract or estimate. Where no specific warranty is stated, we will address defects in workmanship that arise within a reasonable period after project completion, as determined on a case-by-case basis.
Warranties, where provided, apply to defects in workmanship and do not cover damage caused by vehicle traffic beyond the normal use the surface was designed for, damage caused by soil movement, tree roots, or acts of nature, damage resulting from the customer's failure to follow post-installation care instructions, or normal aging and weathering of pavement materials.
Except as expressly stated in a written contract for a specific project, all services and website content are provided "as is" and "as available" without warranty of any kind, express or implied. We make no warranty that services will be free from defects beyond the workmanship warranty described above, or that website content will be error-free, current, or complete. Pavement materials are subject to normal aging and wear, and no contractor can guarantee indefinite performance of asphalt or sealcoating products.
To the fullest extent permitted by law, South Gate Asphalt Paving shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this Site or from the services we provide, even if we have been advised of the possibility of such damages.
Our total liability for any claim related to services provided shall not exceed the amount paid by the customer for the specific project giving rise to the claim. This limitation applies regardless of the legal theory under which the claim is made.

If a dispute cannot be resolved through direct communication, the parties agree to attempt mediation before pursuing litigation. Any legal action arising from these terms or from services provided shall be subject to the jurisdiction and venue of the courts located in Los Angeles County, California.
These Terms and Conditions and any disputes arising from them or from the services we provide shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
